(51) Transfers which are not based on an adequacy decision should only be allowed if appropriate safeguards have been provided for in a legally binding instrument ensuring the protection of personal data or if Eurojust has assessed all the circumstances related to the transfer of data and considers, on the basis of that assessment, there are appropriate safeguards for the protection of personal data. Such legally binding instruments could, for example, constitute legally binding bilateral agreements concluded by Member States and implemented in their legal order and which could be implemented by data subjects in order to ensure compliance with data protection requirements and the rights of data subjects, including the right to an effective administrative or judicial remedy.
